Terms and Conditions (AGB)

1. Scope
These Terms and Conditions (AGB) apply to all orders placed through the online shop Culture Drops (operated by Maximilian Ecker, Kreuzgasse 18/11, 1180 Vienna, Austria, email: accounts@free-agents.io). They apply exclusively to consumers within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG). Deviating terms of the customer are not recognized unless we expressly agree to their validity in writing.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order (invitatio ad offerendum).
By submitting an order through the online shop, you make a binding offer to purchase. You will first receive an automatic order confirmation by email documenting receipt of your order. The purchase contract is only concluded when we ship the goods and you receive a shipping confirmation.
3. Prices and Payment Terms
All stated prices are final prices and include statutory VAT. Additional delivery and shipping costs are shown separately during the order process and are borne by the customer unless otherwise stated. Orders with a cart subtotal of €100 or more are delivered free of shipping charges.
The available payment methods are displayed at checkout. Payment is due upon completion of the order.
4. Delivery and Shipping
All products are manufactured using print-on-demand. The estimated delivery time is shown on the respective product page and during the order process. For further information, please see our Shipping Policy.
We deliver to the delivery address provided by the customer during the order process. The risk of accidental loss and accidental deterioration of the goods passes to the customer upon handover.
5. Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
6. Right of Withdrawal
You have the right to withdraw from the contract within 14 days without giving any reason, in accordance with §§ 11–14 of the Austrian Distance and Off-Premises Transactions Act (FAGG) and Art. 9–15 of EU Directive 2011/83/EU. 7. Warranty
Your statutory warranty rights (§§ 922–933 ABGB) remain fully unaffected. If you receive a defective, damaged, or incorrect product, you are entitled to free repair, replacement, price reduction, or rescission of the contract under Austrian law. The warranty period is 2 years from delivery. For defects that occur within the first year, it is presumed that the defect already existed at the time of delivery. 8. Print-on-Demand Products
All products offered in this shop are produced individually using print-on-demand after the order is placed. Since the designs are specified by us and not individually designed by the customer, the exception under § 18 para. 1 no. 3 FAGG (goods made to customer specifications) does not apply. The full statutory right of withdrawal applies to all products.
9. Liability
We are liable without limitation for intent and gross negligence as well as for damages arising from injury to life, body, or health. In the case of slight negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical of the contract. Mandatory statutory liability provisions, in particular under the Product Liability Act (PHG), remain unaffected.
10. Online Dispute Resolution
The European Commission's Online Dispute Resolution (ODR) platform ceased operation on 20 July 2025 and is therefore no longer available. If you have a complaint, please contact us directly at accounts@free-agents.io; our full contact details are stated in our Legal Notice.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Applicable Law and Place of Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers with habitual residence in the EU, the mandatory consumer protection provisions of their respective country of residence additionally apply, insofar as these are more favorable to the consumer. The place of jurisdiction for all disputes is, to the extent legally permissible, Vienna, Austria. The consumer's statutory right to bring an action before the court of their place of residence remains unaffected.
12. Severability Clause
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
